BBI App — Privacy Policy

Bangin’ Body Index LLC (“we,” “our,” or “us”) operates the BBI App (the “App”), available on the

Apple App Store. This Privacy Policy explains how we collect, use, store, and protect your personal

information when you use the App. By downloading and using the App, you agree to the practices

described in this policy. If you do not agree with any part of this Privacy Policy, please do not

use the App.

1. Information We Collect

We collect the following categories of information when you use the BBI App:

1. Account & Identity Information

• Full name
• Email address
• Password (stored in encrypted form)
• Age
• Gender

1. Health & Biometric Data

• Body weight
• Waist size
• Body fat percentage (as measured via 3D body scan)
• Body composition data derived from the 3D scanning process
• Fitness test results
• User-defined fitness goals (e.g., muscle gain, weight loss)
• Target body weight, waist size, and body fat percentage
• BBI (Biometric Body Index) score

1. Photos & Images

• User-submitted photos used for the AI Photo Imaging feature, which generates a visual projection

of your future physique based on your goals.

1. Financial & Payment Information

• Subscription and payment processing is handled by Apple’s in-app purchase system. We do not

directly collect, store, or process your credit card or payment information.

• Device type, operating system, and app version
• IP address and general location (country/region)
• In-app activity logs (features accessed, session duration)
• Crash reports and diagnostic data

2. How We Use Your Information

• To create and maintain your account
• To provide, operate, and improve the BBI App and its features
• To calculate your BBI score and deliver personalized biometric insights
• To generate AI Photo Imaging projections based on your submitted photos and goals
• To deliver motivational affirmations tailored to your fitness progress
• To process and manage your subscription via Apple’s in-app purchase system
• To respond to your support requests and communications
• To send important service-related notifications (e.g., updates, security alerts)
• To analyze aggregate usage trends and improve app performance
• To comply with applicable legal obligations

We do not use your data to provide nutrition plans, workout routines, or medical advice. The BBI

App is a biometric tracking and motivational tool, not a medical or dietary application.

3. Health & Biometric Data Special Notice

The BBI App collects health and biometric information, including body composition data derived from

3D body scans. This data is sensitive by nature. We treat it with the highest level of protection

and handle it in accordance with applicable law, including where relevant the California Consumer

Privacy Act (CCPA) and other state privacy laws.

To generate your body measurements, the front and side photos from your body scan, together with

your height, weight, gender, and age, are transmitted to a third-party AI measurement provider,

3DLook, Inc. (FitXpress). 3DLook processes this data to return body measurements (such as body

fat percentage and circumferences) that are used to calculate your BBI score. It acts solely as a

processor on our behalf and is bound by a data processing agreement.

This data is transmitted only after you provide explicit consent in the app. Before the scan is

processed, the app shows a consent screen that names 3DLook and states exactly what will be sent,

and nothing is sent unless you agree. If you decline, no data is sent.

We do not use your biometric data for advertising, profiling, or sale to third parties. Your health

data is used solely to power the features of the App as described in this policy.

If you are located in Illinois, Texas, Washington, or another state with a Biometric Information

Privacy Act (BIPA) or equivalent law, your biometric data is collected solely with your explicit

consent, used only for the purposes stated herein, and will be destroyed in accordance with

applicable law upon account deletion or as required by statute.

4. Photos & AI Photo Imaging

When you opt into the AI Photo Imaging feature, you voluntarily upload a photo of yourself. To

generate a visual representation of your potential future physique, this image and a text prompt are

transmitted to a third-party AI provider, Replicate, Inc., which runs Google’s image

generation model on our behalf.

This image is transmitted only after you provide explicit consent in the app. Before the image

is processed, the app shows a consent screen that names Replicate (Google’s model) and states

exactly what will be sent, and nothing is sent unless you agree. If you decline, no data is sent.

• Data sent: the photo you upload and a text description of the requested result. No name, email, or

contact details are sent to the AI provider.

• Photos are used solely for generating your AI Photo Imaging result.
• We do not use your photos for advertising, profiling, or to train AI models without your separate,

explicit consent.

• Photos are stored securely and are not shared with third parties except the AI provider above,

which is bound by a data processing agreement.

• You may delete your photos and AI-generated images at any time through your account settings.

5. How We Share Your Information

We may share your data only in the following circumstances:

• Service Providers: Certain third-party vendors (e.g., cloud hosting, analytics, 3D body

scanning, and AI image processing providers) assist in operating specific features of the App. All

user data processed by these vendors flows directly into BBI’s own system. These vendors act

solely as processors operating on BBI’s instruction; they have no independent ownership, retention

rights, or ability to use your data for any purpose outside of delivering the specific function

they perform within the App. They are bound by strict contractual obligations to that effect.

• Apple App Store: Apple processes subscription payments and may collect certain technical data

per Apple’s own privacy policy.

• Legal Requirements: If required to disclose information by law, court order, or governmental

authority.

• Business Transfers: In the event of a merger, acquisition, or sale of all or substantially all

of our assets, your data may be transferred. You will be notified of any such change.

• With Your Consent: For any other purpose with your explicit prior consent.

6. Data Retention

We retain your personal and health data for as long as your account is active or as needed to

provide services. If you delete your account:

• Your personal information, biometric data, and photos will be deleted within 30 days of your

account deletion request.

• Some anonymized, aggregated data may be retained for analytics purposes.
• Certain records may be retained longer if required by law.

7. Data Security

We implement industry-standard technical and organizational measures to protect your data,

including:

• Encryption of data in transit (TLS/SSL) and at rest
• Secure cloud infrastructure with access controls
• Regular security assessments and vulnerability monitoring
• Limited internal access to sensitive health data on a need-to-know basis

No system is 100% secure. While we take your security seriously, we cannot guarantee absolute

protection against all potential threats. If a breach occurs that affects your rights and freedoms,

we will notify you in accordance with applicable law.

8. Your Rights & Choices

Depending on your location, you may have the following rights:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate or incomplete data.
• Deletion: Request deletion of your personal data and account.
• Data Portability: Request your data in a structured, machine-readable format.
• Opt-Out: Opt out of non-essential communications at any time.
• Withdraw Consent: Where processing is based on consent (e.g., body scan data, photos),

withdraw consent at any time without affecting prior processing.

9. Children’s Privacy

The BBI App is not directed to children under the age of 13 (or under 16 in certain jurisdictions).

We do not knowingly collect personal information from children. If you are a parent or guardian and

believe your child has provided us with personal data, please contact us immediately at the email

address below and we will take steps to delete such information.

10. Apple App Store — Additional Disclosures

As the BBI App is distributed via the Apple App Store, the following applies:

• We comply with Apple’s App Store Review Guidelines and Apple’s privacy requirements, including App

Privacy Labels.

• In-app purchases and subscription management are governed by Apple’s Terms of Service and Apple

Media Services Terms and Conditions.

• You may manage or cancel your subscription at any time through your Apple ID account settings.
• Apple may collect certain data per its own privacy policy (available at apple.com/legal/privacy).

11. Third-Party Services

The App uses the following third-party AI providers to deliver specific features. In each case, the

data below is transmitted only after you provide explicit in-app consent:

• 3DLook, Inc. (FitXpress): Receives your body-scan front and side photos plus your height,

weight, gender, and age to compute body measurements used for your BBI score.

The App may also use third-party services for analytics and cloud infrastructure. Bangin’ Body Index

LLC retains full ownership and control over all user data collected through the App at all times.

Third-party providers operate strictly as processors within BBI’s environment; they are permitted to

handle user data only to perform their designated function within the App and have no independent

rights to access, retain, or use that data for any other purpose. We only work with providers who

meet our data protection standards and are bound by contractual obligations that enforce these

restrictions.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the Effective Date

at the top and notify you via in-app notification or email where required by law. Your continued use

of the App after any update constitutes acceptance of the revised policy.
