These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Bangin’ Body Index LLC (“Company,” “we,” “our,” or “us”) governing your access to and use of the BBI App (the “App”), available on the Apple App Store.

Please read these Terms carefully before downloading or using the App. By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you represent that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You will use the App only in compliance with these Terms and all applicable laws.

2. Description of the App

The BBI App is a biometric tracking and motivational wellness application. It enables users to:

  • Create an account and input personal details (name, age, gender, fitness goals).
  • Undergo a 3D body scan to measure body fat percentage, weight, and waist size.
  • Set and track target body composition goals.
  • Complete a fitness assessment.
  • Access the AI Photo Imaging add-on to visualize a projected future physique.
  • Receive a personalized BBI (Biometric Body Index) score.
  • Receive AI-generated motivational affirmations.

The App does NOT provide nutrition plans, dietary advice, workout routines, or medical diagnoses. It is a biometric monitoring and motivational tool only.

3. Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and promptly notify us of any unauthorized access.
  • Accept responsibility for all activities that occur under your account.
  • Not create more than one account or transfer your account to another person.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or unlawful behavior.

4. Subscription & Payments

The BBI App operates on a subscription model. By subscribing, you agree to the following:

  • Subscriptions are billed through Apple’s in-app purchase system.
  • Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Payment is charged to your Apple ID account upon confirmation of purchase.
  • Subscription management and cancellation must be done through your Apple ID Account Settings.
  • No refunds are provided for partial subscription periods, except where required by applicable law or Apple’s refund policy.
  • We reserve the right to change subscription pricing with advance notice. Continued use after a price change constitutes acceptance.

5. Health Disclaimer & Medical Advice

IMPORTANT — PLEASE READ:

The BBI App is a general wellness and biometric tracking tool. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

  • The BBI score and body composition data provided by the App are informational estimates derived from user inputs and 3D scanning technology. They are not clinical measurements.
  • The AI Photo Imaging feature produces visualizations for motivational purposes only and does not represent medically validated projections.
  • Motivational affirmations are general in nature and do not constitute psychological or therapeutic advice.
  • Always consult a qualified physician, dietitian, or fitness professional before beginning any fitness or wellness program.
  • Do not disregard or delay seeking professional medical advice based on information provided by the App.

Bangin’ Body Index LLC assumes no liability for any health outcomes, injuries, or adverse effects arising from use of the App or reliance on its outputs.

6. AI Photo Imaging Feature

The AI Photo Imaging feature is an optional add-on. By using this feature, you:

  • Consent to submitting your photo for AI processing to generate a visualized future physique.
  • Represent that you have the right to submit the photo and that it is a photo of yourself.
  • Acknowledge that the generated image is an AI-produced visualization for motivational purposes only and may not reflect achievable or realistic outcomes.
  • Agree not to use AI-generated images from the App for misleading, deceptive, or harmful purposes.

7. Acceptable Use

You agree not to use the App to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Upload or transmit content that is false, harmful, abusive, defamatory, or infringes on intellectual property rights.
  • Attempt to gain unauthorized access to our systems or another user’s account.
  • Reverse engineer, decompile, or disassemble any part of the App.
  • Use the App for commercial purposes or on behalf of a third party without our written consent.
  • Interfere with or disrupt the integrity or performance of the App.

8. Intellectual Property

All content, features, trademarks, logos, and software within the BBI App are the exclusive property of Bangin’ Body Index LLC or its licensors and are protected by applicable intellectual property laws. The BBI App and its underlying technology are the subject of a pending patent application.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written permission.

“Biometric Body Index,” “BBI,” and related marks are trademarks of Bangin’ Body Index LLC. All rights reserved.

9. Apple App Store – Additional Terms

Your use of the App is also subject to Apple’s App Store Terms of Service. The following terms apply specifically to App Store distribution:

  • These Terms are between you and Company only, not Apple, Inc.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if any).
  • Apple is not responsible for addressing any claims by you or a third party relating to the App or your use of the App.
  • Apple is a third-party beneficiary to these Terms and may enforce them against you.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BANGIN’ BODY INDEX LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH OUTCOMES, OR PERSONAL INJURY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

Our total aggregate liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Indemnification

You agree to defend, indemnify, and hold harmless Bangin’ Body Index LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Any content you submit through the App.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

Upon termination:

  • Your right to use the App immediately ceases.
  • You may request deletion of your personal data per the Privacy Policy.
  • Provisions that by their nature should survive termination will remain in effect.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in New York, NY under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

You waive any right to participate in a class-action lawsuit or class-wide arbitration.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date and notify you via in-app notice or email. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

If you do not agree to the changes, you must stop using the App and delete your account.
